B. COOKIES AND ONLINE ANALYTICS

 

We use a variety of online tracking and analytics tools (e.g., cookies, flash cookies, pixel tags, and HTML5) to collect and analyze information as you use the Services. Among other things, these technologies allow us to offer you a more tailored experience in the future, by understanding and remembering your particular browsing and usage preferences.

C. ONLINE ADVERTISING

 

1. Online Advertising Overview

 

We neither have access to, nor does this Privacy Policy govern, the use of cookies or other tracking technologies that may be placed on your device you use to access the Services by such non-affiliated third parties or participating vendors. If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative’s Consumer Opt-Out link, the Digital Advertising Alliance’s Consumer Opt-Out link, or Your Online Choices to opt-out of receiving tailored advertising from companies that participate in those programs. To opt out of Google Analytics for display advertising or customize Google display network ads, visit the Google Ads Settings page. We do not control these opt-out links or whether any particular company chooses to participate in these opt-out programs. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.

 

Please note that if you exercise the opt out choices above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.

 

 

 

 

2. Notice Concerning Do Not Track.

 

Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our website for online advertising and analytics purposes, and that is why we provide the variety of opt-out mechanisms listed above. D.5. Third Parties for Legal Purposes. This includes exchanging information with other companies and organizations for fraud protection, and spam/malware prevention, and similar purposes.

Certain features of our Services make it possible for you to share comments publicly and privately with other users, such as through our public forums, chat rooms, blogs, personal messages, review features, and message boards. You should be aware that any information you provide or post in these ways may be read, collected, and used by others who access them. While we do not have an obligation to monitor the content of messages sent using our Services, we reserve the right to, in our discretion. We encourage you to be cautious about the information you submit (e.g., choose a username that does not disclose your personal identity). Whenever you post something in our Services, social media and any other third party platforms we control, it may be impossible to remove all instances of the posted information, for example, if someone has taken a screenshot of your posting. You may be required to register with a third-party application to post a comment. Moreover, please note that if you participate in one of our registry programs, in some instances, you can choose to make your registries available only to guests and friends via a password. If you do not elect this option, then any user will be able to search for and view your registry by using your first and/or last name and other information regarding your event.

 

F. AGGREGATE AND DE-IDENTIFIED INFORMATION

 

We may aggregate and/or de-identify any information collected through the Services so that such information can no longer be linked to you or your device (“Aggregate/De-Identified Information”). We may use Aggregate/De-Identified Information for any purpose, including without limitation for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners, and sponsors, in our discretion.

 

G. YOUR CHOICES AND RIGHTS

 

You have certain rights with respect to your information as further described in this Section, in addition to any rights discussed elsewhere in this Privacy Policy.

 

Marketing Communications. You may instruct us not to use your information to contact you by email, postal mail, or phone regarding products, services, promotions and special events that might appeal to your interests by contacting us using the information below. In commercial email messages, you can also opt out by following the instructions located at the bottom of such emails. Please note that, regardless of your request, we may still use and share certain information as permitted by this Privacy Policy or as required by applicable law. For example, you may not opt out of certain operational emails, such as those reflecting our relationship or transactions with you.

 

Consumer Privacy Rights. Depending on the laws of your local jurisdiction, you may have certain rights and choices with respect to your information. For example, under local laws, you may be able to ask us to:

We will consider all requests and provide our response within the time period stated by applicable law. We will let you know where this is the case or if certain rights don’t apply in your country or state of residence. We may request you provide us with information necessary to verify your identity before responding to your request as required or permitted by applicable law. Testimonials/Notable Quotes. On some of our Services, and with your consent, we post notable quotes or testimonials which may contain information such as your name, event type, city, state, and quote or testimonial. Requests for removal of a user testimonial can be done by contacting us as detailed in the “SBSN Contact Information” section below.

 

H. PRIVACY INFORMATION FOR CALIFORNIA RESIDENTS

 

If you are a California resident, California law requires us to provide you with some additional information regarding your rights with respect to your “personal information” (as defined in the California Consumer Privacy Act (“CCPA”)).

 

A. Your California Privacy Rights

 

CCPA Rights Disclosure. If you are a California resident, the CCPA allows you to make certain requests about your personal information. Specifically, the CCPA allows you to request us to:

  • Inform you about the categories of personal information we collect or disclose about you; the categories of sources of such information; the business or commercial purpose for collecting your personal information; and the categories of third parties with whom we share/disclose personal information.

  • Provide access to and/or a copy of certain personal information we hold about you.

  • Delete certain personal information we have about you.

  • Provide you with information about the financial incentives that we offer to you, if any.

 

The CCPA further provides you with the right to not be discriminated against (as provided for in applicable law) for exercising your rights.

Please note that certain information may be exempt from such requests under California law. For example, we need certain information in order to provide the Services to you. We also will take reasonable steps to verify your identity before responding to a request, which may include, at a minimum, depending on the sensitivity of the information you are requesting and the type of request you are making, verifying your name, email address, and other account information. You are also permitted to designate an authorized agent to submit certain requests on your behalf. In order for an authorized agent to be verified, you must provide the authorized agent with signed, written permission to make such requests or a power of attorney. We may also follow up with you to verify your identity before processing the authorized agent’s request. 

 

B. Notice of Right to Opt Out of Sale of Personal Information

 

California residents may opt out of the “sale” of their personal information. California law broadly defines “sale” in a way that may include when we share your information with third parties to provide you with offers and promotions that we believe may be of interest to you. It also may include allowing third parties to receive certain information, such as cookies, IP address, and/or browsing behavior, to deliver targeted advertising on the Services or other services. Advertising, including targeted advertising, enables us to provide you certain content for free and allows us to provide you offers relevant to you.

Depending on what Services you use, we may provide the following categories of personal information to third parties for these purposes:

C. California “Shine the Light” Disclosure

 

The California “Shine the Light” law gives residents of California the right under certain circumstances to opt out of the sharing of certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. If you would like to opt out of such sharing, please use the sale opt out form noted above.

 

I. PRIVACY INFORMATION FOR NEVADA RESIDENTS

 

Under Nevada law, Nevada residents who have purchased goods or services from us may opt out of the “sale” of “covered information” (as such terms are defined under Nevada law) for monetary consideration to a person for that person to license or sell such information to additional persons. “Covered information” includes first and last name, address, email address, and phone number, or an identifier that allows a specific person to be contacted either physically or online. As discussed above, we share your information with certain third parties that we believe can provide you with offers and promotions for products and services of interest to you. In some circumstances, this sharing may qualify as a sale under Nevada law. If you are a Nevada resident who has purchased goods or services from us, you may submit a request to opt out of such activity emailing us at contact@sbsnbride.com. Please note we may take reasonable steps to verify your identity and the authenticity of the request.

 

J. THIRD PARTY LINKS AND FEATURES

 

The Services may contain links, banners, widgets or advertisements (e.g., a “Share It!” or “Like” button) that lead to other websites, apps, or services not subject to this Privacy Policy (including other sites that may be co-branded with our brands). On some of our Services, you may also be able to register with or purchase directly from third-party retailers. We are not responsible for the privacy practices or the content of any other websites to which the Services link or which link to our Services. The privacy policies of these other sites will govern the collection and use of your information thereon, and we encourage you to read each such policy to learn about how your information may be treated by others.

 

K. CHILDREN’S PRIVACY

 

The Services are intended for general audiences and not for children under the age of 13. If we become aware that we have collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act) from children under the age of 13 without legally-valid parental consent, we will take reasonable steps to delete it as soon as possible. We do not knowingly process data of EU residents under the age of 16 without parental consent. If we become aware that we have collected data from an EU resident under the age of 16 without parental consent, we will take reasonable steps to delete it as soon as possible. We also comply with other age restrictions and requirements in accordance with applicable local laws.

 

L. INTERNATIONAL USERS

 

Our Services are targeted to individuals located in the United States and Canada. Please note that in providing services to you, your information will be transferred to the United States. Moreover, SBSN may subcontract the processing of your data to, or otherwise share your data with, other members within the SBSN group, trusted service providers, and trusted business partners located in countries other than your country of residence, in accordance with applicable law. Such third parties may be engaged in, among other things, the provision of Services to you, the processing of transactions and/or the provision of support services. By providing us with your information, you acknowledge any such transfer, storage or use. 

 

If you live in the EEA, please note that if we provide any information about you to any non-EEA members of our group or third-party information processors, we will take appropriate measures to ensure such companies protect your information adequately in accordance with this Privacy Policy. These measures include signing Standard Contractual Clauses in accordance with EU and other data protection laws to govern the transfers of such data. If applicable, you may make a complaint to the data protection supervisory authority in the country where you are based. Alternatively, you may seek a remedy through local courts if you believe your rights have been breached.

We take a variety of physical, technical, administrative, and organizational security measures to protect your information against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access. However, no method of transmission over the Internet, and no means of electronic or physical storage, is absolutely secure. As such, you acknowledge and accept that we cannot guarantee the security of your information transmitted to, through, or on our Services or via the Internet and that any such transmission is at your own risk.

 

When you sign up for an account, you may be required to establish a username and password. You represent and warrant that you own the User Content posted by you on or through the SBSN Website or that you otherwise have sufficient right, title and interest in and to such User Content to grant SBSN the licenses and rights set forth below without violating, infringing or misappropriating the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any person. You agree to pay for all royalties, fees, and any other monies owing any person by reason of any User Content posted by you to or through the SBSN Website.


  • After posting, uploading or embedding User Content to the SBSN Website, you continue to retain such rights in such User Content as you held prior to posting such User Content on the SBSN Website and you continue to have the right to use your User Content in any way you choose. However, by displaying or publishing ("posting") any User Content on or through the SBSN Website, you hereby grant to SBSN a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, adapt, modify (e.g., re-format), re-arrange, and distribute your User Content through any manner, mode of delivery, or media now known or developed in the future. Where possible, photographs used on the SBSN Website and in any SBSN publication will include attribution to the photographer and/or copyright holder. As part of the non-exclusive license you grant to SBSN, you agree to allow SBSN and other Users of the SBSN Website and SBSN Services to add your User Content to their  Inspiration Board(s) and post these Inspiration Board(s) on other websites provided that such use is for non-commercial purposes only.


  • Without this license, SBSN would be unable to provide the SBSN Services or its publications. For example, the license you grant to SBSN is non-exclusive (meaning you are free to license your Content to anyone else in addition to SBSN), fully-paid and royalty-free (meaning that SBSN is not required to pay you for the use of the User Content that you post), sublicensable (so that the User Content you post on the SBSN Website is able to be distributed for wide exposure via SBSN network affiliates; third party content providers; and subcontractors, such as Internet content delivery networks, to provide the SBSN Services), and worldwide (because the Internet and the SBSN Services are global in reach).


  • This license will terminate at the time you remove your User Content from the SBSN Website except as to any User Content that SBSN has sublicensed prior to your removal of your User Content from the SBSN Website, which license shall continue in perpetuity. To remove User Content, please send a request to contact@sbsnbride.com and include a brief description of the item(s) to be removed along with a URL of the item(s) current location on the SBSN Website. We will remove the item(s) as quickly as possible and in line with our record retention policies.


  • The SBSN Services contain Content owned by SBSN. SBSN Content is protected by copyright, trademark, trade secret and other laws, and SBSN owns and retains all rights in the SBSN Content and the SBSN Services. SBSN hereby grants you a limited, revocable, non-sublicensable license to view the SBSN Content (excluding any software code) solely for your personal use in connection with viewing the SBSN Website and using the SBSN Services. Without limiting the generality of the foregoing, you agree that you shall not copy, modify, translate, publish, broadcast, transmit, license, sublicense, assign, distribute, perform, display, or sell any SBSN Content appearing on or through the SBSN Services.

You expressly agree that you will not upload to, submit to, or embed on the SBSN Website or include in your SBSN dashboard/profiles(s) any User Content that violates this Agreement or that is contrary to the purposes of the SBSN Services, that may be offensive, illegal or violate the rights of, harm, or threaten the safety of any person, or that presents any business or individual in a negative light. You further agree that you will not upload to, submit to or embed on the SBSN Website or include in your SBSN dashboard/profiles(s) any photographs or video containing nudity, or obscene, lewd, violent, harassing, libelous, sexually explicit or otherwise objectionable subject matter or any content owned by third parties for which you do not have the right to post, display or publish.


  • SBSN does not endorse or guarantee the accuracy, efficacy, or veracity of the User Content posted by you or other Users. You acknowledge that we have no way to monitor all User Content that is uploaded to or embedded on the SBSN Website and that despite our reasonable efforts to ensure that all User Content is consistent with the purposes of the SBSN Services, Users may post User Content that contains illegal, inaccurate, libelous, inappropriate, offensive or sexually explicit material, products or services, and SBSN assumes no responsibility or liability for this material. SBSN makes no warranties, express or implied, as to any aspect of the User Content uploaded or embedded by you or other Users or to the reliability of the User Content or any material or information that you or other Users transmit to other Users or Visitors via SBSN Services. SBSN reserves the right, in its sole and absolute discretion, to determine whether User Content is appropriate for the SBSN Website and to remove any User Content, without notice or liability to you, which it determines to be inappropriate. Without limiting the generality of the foregoing, the following is a partial list of the types of User Content that SBSN deems to be inappropriate:

SBSN’s right to remove inappropriate User Content shall not be its sole right with respect to inappropriate User Content and SBSN expressly reserves the right to investigate, report and take appropriate legal action against anyone who, in SBSN's sole discretion, violates this provision, including without limitation, reporting you to law enforcement authorities.


  1. Prohibited Activity.You expressly agree that you are prohibited from engaging in, and will not engage in, the following prohibited activities in connection with your use of the SBSN Services:

 


  • copying, modifying, translating, publishing, broadcasting, transmitting, licensing, sublicensing, assigning, distributing, performing, publicly displaying, or selling any Third Party Content or SBSN  Content appearing on or through SBSN Services;


  • criminal or tortious activity, including but not limited to child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, spimming, sending of viruses or other harmful files, copyright infringement, patent infringement, or theft of trade secrets;


  • covering or obscuring the banner advertisements on your personal profile page, or any SBSN  page via HTML/CSS or any other means;


  • any automated use of the system, such as using scripts to add friends or send comments or messages;


  • interfering with, disrupting, or creating an undue burden on the SBSN Services or the networks or services connected to the SBSN Services;


  • attempting to impersonate another User, person, or representative of SBSN;


  • creating a false or misleading profile or SBSN page;


  • using the account, username, or password of another User at any time or disclosing your password to any third party or permitting any third party to access your account;


  • selling or otherwise transferring your profile, without our permission;


  • using any information obtained from SBSN Services in order to harass, abuse, or harm another person;


  • displaying an advertisement on your profile, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the SBSN Services on behalf of that person, such as placing commercial content on your profile, posting blogs or bulletins with a commercial purpose, using SBSN's name to broker favorable discounts with vendors, or sending private messages with a commercial purpose; or


  • using the SBSN Services in a manner inconsistent with any and all applicable laws and regulations.

 


  1. Copyright Policy.  You may not post, modify, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information belonging to SBSN or others (including without limitation Third Party Content or SBSN Content) without obtaining the prior written consent of the owner of such copyrighted material, trademarks, or other proprietary information. Without limiting the foregoing, if you believe that your work has been copied and posted on the SBSN Website in a way that constitutes copyright infringement, please contact at contact@sbsnbride.com for information about how to file a take-down notice. It is the policy of SBSN to terminate Users who are deemed to be repeat offenders in the sole discretion of SBSN.


  2. User Disputes.You are solely responsible for your interactions with other SBSN Users. SBSN reserves the right, but has no obligation, to monitor disputes between you and other Users and to immediately terminate the privileges of any User for any reason or for no reason.


  3. Privacy.Use of the SMPretty Services is also governed by our Privacy Policy, located at our Privacy Policies tab and incorporated into this Agreement by this reference.


  4. Promotions and Giveaways. From time to time, SBSN will offer sweepstakes, promotions or giveaways on behalf of third parties. Each promotion or giveaway will have its own rules that will disclose what information is gathered, how that information is used, and who that information is shared with. SBSN encourages you to review such information prior to engaging with each sweepstakes, promotion or giveaway, it may be binding on you

Disclaimer of Warranties.THE SBSN SERVICE IS PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND AND SBSN EXPRESSLY DISCLAIMS ANY AND ALL EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. You agree to defend, indemnify and hold harmless SBSN, and any parent, subsidiary, and affiliate, director, officer, employee, licensor, distributor, supplier, agent, reseller, owner and operator, vendor from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, including but not limited to reasonable attorneys' fees, made by you or any third party due to or arising out of your use of SBSN Services in violation of this Agreement and/or arising from: (i) your use of and access to the SBSN Website; (ii) your violation of any term of these Terms of Use; (iii) your use of SBSN Services in violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party. This defense and indemnification obligation will survive these Terms of Use and your use of the SBSN Website and/or the SBSN Services


  5. Other.This Agreement is accepted upon your access and use of the SBSN Website or any of the SBSN Services and is further affirmed by you becoming a User. This Agreement constitutes the entire agreement between you and SBSN regarding the use of the SBSN Services. The failure of SBSN to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. The section titles in this Agreement are for convenience only and have no legal or contractual effect. SBSN is a trademark of SBSN, Something Borrowed Something New, SBSN Bride. This Agreement operates to the fullest extent permissible by law. If any provision of this Agreement is unlawful, void or unenforceable, that provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.


  6. Waiver and Severability of Terms.The failure of SBSN to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.


  7. Statute of Limitations.You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be permanently barred.
